Terms & Conditions

Welcome to Haatza India Private Limited (“Haatza”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your use of the Haatza website, mobile application, and related services (together, the “Platform”). By accessing, registering, or purchasing on Haatza, you agree to be bound by these Terms, Privacy Policy, and all applicable laws in India.

If you do not agree, please do not use the Platform.

 

1. Eligibility

  • You must be 18 years or older and capable of entering into a legally binding contract under the Indian Contract Act, 1872.

  • If you are under 18, you may use the Platform only with the involvement of a parent/guardian.

2. Account Registration

  • You agree to provide accurate, complete, and updated information while creating an account.

  • You are responsible for maintaining confidentiality of your login details.

  • Haatza reserves the right to suspend or terminate accounts for misuse, fraud, or violation of these Terms.

3. Use of the Platform

  • The Platform is provided for personal, non-commercial use by customers and business use by registered sellers.

  • You agree not to:

    • Engage in fraudulent activities, including fake orders or payment reversals.

    • Upload unlawful, defamatory, or infringing content.

    • Misuse the platform for spamming, phishing, or data scraping.

4. Product Listings & Pricing

  • Product descriptions, specifications, and prices are uploaded by sellers. Haatza strives for accuracy but does not warrant that such content is error-free.

  • Prices are subject to change at the seller’s discretion. Taxes are applied as per GST and other applicable Indian laws.

  • In case of a pricing error, Haatza may cancel the order and issue a full refund.

5. Orders, Payments & Delivery

  • Orders are confirmed only after successful payment (except COD orders).

  • Payment options: UPI, Net Banking, Debit/Credit Card, Wallets, and Cash on Delivery (where available).

  • Delivery timelines are indicative. Delays may occur due to logistics, force majeure, or serviceability issues.

6. Returns, Replacements & Refunds

  • Returns/replacements are subject to the Haatza Return & Refund Policy, displayed on product pages.

  • Certain items (perishables, hygiene-related, customized) may be non-returnable.

  • Refunds are processed to the original payment method within timelines prescribed by RBI and banking partners.

7. Cancellations

  • Customers can cancel orders as per the Cancellation Policy before shipment.

  • Sellers or Haatza may cancel orders in case of stock unavailability, payment issues, or regulatory restrictions.

  • Refunds will be initiated in such cases.

8. Seller Responsibilities

  • Sellers must comply with Consumer Protection (E-commerce) Rules, 2020, GST regulations, and other applicable Indian laws.

  • Sellers are solely responsible for product quality, authenticity, warranties, and after-sales obligations.

  • Misleading ads, counterfeit goods, or prohibited items will result in blacklisting and legal action.

9. Intellectual Property

  • All content, branding, design, software, and trademarks on the Platform belong to Haatza or its licensors.

  • You may not reproduce, copy, distribute, or exploit any material without prior written consent.

10. Limitation of Liability

  • Haatza acts as an intermediary under the Information Technology Act, 2000.

  • Liability for product defects, damages, or non-performance lies with the seller.

  • Haatza is not liable for indirect, incidental, or consequential losses arising from your use of the Platform.

11. Privacy & Data Protection

  • We collect and process personal data in accordance with our Privacy Policy and applicable Indian data protection laws.

  • You consent to communication via SMS, email, calls, and app notifications regarding orders, promotions, and account activities.

12. Grievance Redressal (As per Indian Law)

  • Haatza has appointed a Grievance Officer in compliance with the IT Act and Consumer Protection Rules.

Complaints will be acknowledged within 48 hours and resolved within 30 days.

13. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of India.

  • In case of disputes, parties shall first attempt amicable settlement.

  • Failing which, disputes shall be subject to the exclusive jurisdiction of courts in [Your City/State, India].

14. Amendments

  • Haatza may update these Terms from time to time to comply with laws or improve services. Updates will be posted on this page, and continued use of the Platform constitutes acceptance.
